Privacy Policy

This policy explains what personal data we collect through the Kolektivo website, why, and what rights you have. We keep our data practices lean and only collect what we need.

1. Who we are

This website is operated by Kolektivo Curaçao Foundation ("Kolektivo", "we", "us", or "our"), based in Willemstad, Curaçao. We are the controller responsible for the personal data described in this policy.

We do not have a separate Data Protection Officer; the same contact handles all privacy matters.

2. The short version

  • You can browse the site without giving us any personal information.
  • We only receive personal data when you choose to fill in one of our forms.
  • We use Google Analytics to understand general site usage.
  • We do not sell your data, and we do not run a newsletter or marketing list.

Submitting a form is always optional. If you do not want to share information with us, simply do not complete the form.

4. Legal basis

Where data protection law (including the EU General Data Protection Regulation, which may apply because part of our audience is the Antiano diaspora in the Netherlands) requires a legal basis, we rely on:

  • Your consent, when you choose to submit a form, and for analytics where consent is required.
  • Our legitimate interest in understanding and improving how our site is used, kept to a minimum and balanced against your privacy.

You can withdraw consent at any time by contacting us, though this will not affect processing already carried out.

5. Forms (Tally)

Our forms are provided and hosted by Tally (Tally B.V.). When you submit a form, your responses are stored in Tally on our behalf. We access them there to read and respond to what you sent. We generally leave submissions in Tally rather than exporting them elsewhere.

Tally processes this data as our service provider. You can read how Tally handles data in their own privacy policy at tally.so.

6. Analytics (Google Analytics)

We use Google Analytics to collect anonymous, aggregated information about how visitors use the site, such as which pages are viewed and roughly where visitors come from. This helps us improve the site. Google Analytics uses cookies and may process some data outside Curaçao, including in the United States.

We have chosen not to use a cookie consent banner on this small site. If you prefer not to be measured by Google Analytics, you can opt out by adjusting your browser settings, using a tracking-blocker, or installing Google's opt-out browser add-on at tools.google.com/dlpage/gaoptout.

7. Who we share data with

We do not sell your personal data. We share it only with the service providers that help us run the site:

  • Tally — for hosting and storing form submissions.
  • Google Analytics — for site usage statistics.
  • Our website host and any technical providers needed to keep the site running.

We may also disclose data if required by law, or to protect our rights and safety.

8. International transfers

Some of our providers, including Google, may process data in countries outside Curaçao and outside the European Economic Area. Where this happens, those providers are expected to apply appropriate safeguards for your data.

9. How long we keep data

We keep form submissions in Tally for as long as they remain useful for the purpose you contacted us about, and we review and remove them when they are no longer needed. Analytics data is retained according to Google Analytics' standard retention settings. You can ask us to delete information you have submitted at any time.

10. Your rights

Depending on where you live and the law that applies, you may have the right to:

  • Ask what personal data we hold about you and request a copy.
  • Ask us to correct inaccurate data.
  • Ask us to delete your data.
  • Object to or restrict certain processing.
  • Withdraw consent you have given.

To exercise any of these, email us at info@kolektivo.cw. We will respond within a reasonable time. If you are in the EU and believe we have not handled your data properly, you also have the right to complain to your local data protection authority.

11. Keeping data safe

We are a small team and rely on reputable providers (Tally, Google) that maintain their own security measures. We take reasonable steps to protect the data we handle, but no method of transmission or storage over the internet is completely secure.

12. Children

This site is not directed at children, and we do not knowingly collect personal data from children. If you believe a child has provided us with personal data, contact us and we will remove it.

13. Changes to this policy

We may update this policy from time to time. The current version will always be posted here with the date it was last updated. Significant changes will be reflected on this page.
